BEACH CART RENTAL AGREEMENT

This Beach Cart Rental Agreement (the “Agreement”) is made and entered into by and between Nova Property Group, LLC. (“Host”) and [Guest Name] (“Guest”).

Rental. Host agrees to rent a beach cart (the “Equipment”) to Guest for the term of their stay, starting on [start date] and ending on [end date]. The use of a golf cart is also included free of charge with the booking of the Beach House.

Payment. Guest shall not be required to pay any additional rental fee for the use of the Equipment. However, if the key to the golf cart is lost during the rental term, Guest shall pay Host a replacement fee of $100.

Use. Guest shall use the Equipment in a careful and proper manner, and shall comply with all applicable laws and regulations in using the Equipment. Guest may use the golf cart on private streets only, and may not take the Equipment outside of the private street under any circumstance. No one shall operate or utilize the golf cart under the age of 16 or any person who is not a guest of our rental home. Guest shall promptly notify Host if any maintenance issues arise in relation to the Equipment. 

The Equipment may only be used for use within the street where the Beach House is located. When not in use, Equipment must be parked within the property of the Beach House. Guest acknowledges that the Equipment is not street legal and will under no circumstance operate on any street outside of the Rental street.  LOCAL LAWS PROHIBIT THE EQUIPMENT FROM BEING OPERATED ON SIDEWALKS, YOU WILL BE TICKETED. 

Any use of the Equipment outside of the street upon which the Beach House is located will be deemed a violation and Guest will be charged a $500 fine on top of any local law enforcement citations, if applicable. 

Loss or Damage. Guest shall be responsible for any loss or damage to the Equipment during the rental term. In the event of loss or damage to the Equipment, Guest shall pay Host the cost of repairing or replacing the Equipment, as determined by Host in its sole discretion. The total replaceable value of the Golf Cart is $14,000.

Indemnification. Guest shall indemnify and hold harmless Host and its affiliates, officers, directors, agents, and employees from and against any and all claims, damages, liabilities, costs, and expenses (including reasonable attorneys’ fees) arising out of or in connection with Guest’s use of the Equipment.

Release and Waiver. Guest hereby releases and waives any and all claims against Host and its affiliates, officers, directors, agents, and employees arising out of or in connection with Guest’s use of the Equipment.

Governing Law. This Agreement shall be governed by and construed in accordance with the laws of the state of Florida, and any disputes arising under this Agreement shall be resolved in the courts located in Walton County, Florida.

Compliance with Walton County Regulations. Guest acknowledges and agrees to comply with all applicable regulations and ordinances of Walton County, Florida, regarding the use of beach carts and golf carts on public and private roads. Host shall not be responsible for any fines or penalties assessed against Guest for noncompliance with such regulations or ordinances.

Entire Agreement. This Agreement constitutes the entire agreement between Host and Guest with respect to the rental of the Equipment, and supersedes all prior or contemporaneous communications and proposals, whether oral or written, between Host and Guest.

Amendments. This Agreement may not be amended or modified except in writing signed by both Host and Guest.

Binding Effect. This Agreement shall be binding upon and inure to the benefit of the parties hereto and their respective heirs, successors, and assigns.

IN WITNESS WHEREOF, the parties have executed this Beach Cart Rental Agreement as of the date first above written.
